In March 2006 my wife and I purchased a home In the Beautiful Palms Bay at Rhodes Ranch by Rhodes Homes

What happened next that has turned out to be a night mare. 

We went to the models and met a  gentleman named Greg who was the sales manager he told us they had a single unit with a golf course view. 

We looked at the house it was nice track home however the view of Rhodes Ranch Golf Course was great. 

We said we would purchase the house in Rhodes Ranch a nice division called Palms Bay. Next to the collection and close to pacific mist.

 We only needed to confirm one thing and that was that we could build a large balcony over looking the view.  He said yes, then went and showed us a statement that said" We welcome balconies". 

WHAT HE FORGOT TO SAY WAS THE HOUSE IS ALREADY BUILT TO CLOSE TO THE PROPERTY LINE AND THAT ACCORDING TO THE CC&R's "You would think that would be the correct statement from a company who has been around as long as Jim Rhodes and Rhodes Homes at Rhodes Ranch has. 

Anyway,  that's only the start of my story. We went for approval with the review committee and they denied our request so we are now waiting for the attorney to re-write the CC&R's for the community. This is taking for ever tonight we are going to the board meeting to see the out come. 9-27-06 Tomorrow we will talk about tonight's actions and the  Design Center IS short comings and misrepresentations. 

Well it happened. Barbara from the neighborhood association from Rhodes homes told us they were working on the amendment to the cc&r's for all communities in RHODES RANCH.

 And that they would amend at the next meeting  however due to miss communications again an empty meeting. Now the question comes up why are we waiting anyway as we were told buy the sales  that we could.

 

After all we needed want to place a very nice balcony on the house that looks very much like the ones in the collection. They are built 5 feet from the property line and not the seven the would like us to build at.

Better yet they built the ones in the collections in 2006 end of year.

Although he is also the guy who shook his head yes that the house also had instant hot water which Rhodes homes does not install in these low end track homes. " it was not a mistake.. BUYERS BEWARE.."

Next the blame for us and not getting all of our window covering shutters. We have two with out shutter form there design center. We paid they played and said Rhodes s

Then we have a problem with the Design Center I.S. on Sunset in Las Vegas 89118

We started by choosing flooring next we decide to get shutters. Here's where the problem comes. We ask does the price include all windows the sales person shows us a diagram and says absolutely. The only window that will not be covered is in the second shower. Because the moisture will warp the wood. So I asked again is that all the windows in the house or should we go to the house and check them. She says no that's all windows I assure you. OK sounds good.

4 weeks latter here comes the installer who covers all windows but three. He says that's all they ordered. So we call the sales rep she says yes, I sad all windows. and you signed off. So I call the manager she is rude and aggressive and says I have a signed contract IT DOES NOT MATTER WHAT WE SAID THIS IS ALL THE COURT LOOKS AT. My next conversation is with the company VP who says "that's all the windows in the blue prints from RHODES HOMES and TALK TO RHODES ABOUT YOUR Coverings'

When I called Rhodes Customer Service and they Never responded they said they would look into it 13 months ago.  Not a call.  5-20-2007

Dear Review board:

When my home was purchased Greg Stone assured me there would be no problem adding a covered balcony, and that I would just have to make it look appropriate. I see now that things have changed. I am wondering if appearing before you is my next step or if I should go after the builder for misrepresentation?

I had specifically asked about this prior to writing the check for the home and had my wife and agent present. Please help me find the next step. My home is 12 feet off the back fence and was in the same place when I was told “no problem”..

I would be glad to appear before you and assure you that I will build a balcony of beauty and quality as to not offend anyone on the golf course. I would only enhance the beauty of the neighborhood. 

After a year of back and forth with the Rhodes Ranch Home Owners association we now are approved for a 5 foot balcony. not big enough to place a small table and chair. We are waiting to push it out to 8.5feet so you can actually use it. Thanks For Reading.

All this over 3.5 feet of balcony and 2 shutters. I would not like to be known for such poor representation.
